1. Introduction and Acceptance

Welcome to The Prints Plus ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website www.theprintsplus.com, including all content, features, products, and services offered through it. By accessing our website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must discontinue use of our website immediately. We reserve the right to modify these Terms at any time. Changes become effective upon posting on this page, and your continued use of the website after any modifications constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

2. Eligibility

To use our website and services, you must be at least 18 years of age and possess the legal authority to enter into a binding contract under Indian law. If you are accessing the website on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms. By placing an order, you confirm that you meet these eligibility requirements.

Minors (individuals under 18 years of age) may browse the website but may not create accounts, place orders, or enter into any transactions without the supervision and consent of a parent or legal guardian.

3. Account Registration and Security

Certain features of our website require you to create an account. When registering, you agree to provide accurate, current, and complete information including your name, email address, phone number, and delivery address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us immediately at support@theprintsplus.com if you become aware of any unauthorised access or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Products and Services

The Prints Plus offers custom-printed products including wallpapers, wall murals, canvas prints, banners, stickers, and related printing services. Product images displayed on our website are for illustrative purposes. While we strive for colour accuracy, slight variations between on-screen representation and the actual printed product may occur due to differences in monitor calibration, colour profiles, and printing processes. Such variations are not considered defects (see our Disclaimer page for details).

We reserve the right to modify, discontinue, or limit the availability of any product or service without prior notice. Product descriptions, specifications, and features are provided to the best of our knowledge but do not constitute a warranty.

5. Pricing and Payments

All prices on our website are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. The final price you pay is computed server-side at the time of checkout and may include shipping charges, COD fees, and applicable taxes. Prices are subject to change without prior notice, but changes will not affect orders that have already been confirmed.

• Shipping: A flat shipping fee of Rs. 99 applies to orders below Rs. 999. Orders of Rs. 999 and above qualify for free standard shipping.
• Cash on Delivery (COD): A COD handling fee of Rs. 30 is charged when COD is selected as the payment method. COD is available for orders up to Rs. 10,000.
• Online Payments: We accept payments via credit cards, debit cards, UPI, net banking, and digital wallets through our payment gateway partner Razorpay. All online transactions are processed over secure, encrypted connections.
• GST: Goods and Services Tax is applied in accordance with prevailing Indian tax law. Our GSTIN is 24AALHK9387B2ZY. A tax invoice is generated for every order.

In the event of a pricing error (e.g., a product listed at an obviously incorrect price due to a technical glitch), we reserve the right to cancel the order and issue a full refund, even after order confirmation.

6. Custom Orders and Design Approval

Many of our products are custom-manufactured to your specifications. For custom orders, the following terms apply:

• Design Approval: For orders involving custom artwork, you will receive a digital proof or preview for approval before production begins. It is your responsibility to review the proof carefully for accuracy in design, text, dimensions, and colour. Once you approve the design (either explicitly or by not responding within the stipulated timeframe), production begins and the order becomes binding.
• Non-Refundable Once in Production: Custom and personalised orders cannot be cancelled, returned, or refunded once production has commenced. This is because custom products are manufactured exclusively for you and cannot be resold.
• File Requirements: Uploaded design files must meet our specifications regarding resolution (minimum 150 DPI for large formats, 300 DPI for standard), file format (JPEG, PNG, PDF, TIFF, AI, or PSD), and colour mode (CMYK preferred). We are not responsible for poor print quality resulting from low-resolution or improperly formatted files.
• Production Timeline: Typical manufacturing time is 3-5 business days after design approval. Complex or bulk orders may require additional time. Estimated timelines are provided in good faith but are not guaranteed.

7. Intellectual Property

All content on the The Prints Plus website -- including but not limited to text, graphics, logos, product images, UI design, software code, and marketing materials -- is the property of The Prints Plus or its licensors and is protected by Indian copyright law and international intellectual property treaties. You may not reproduce, distribute, modify, or create derivative works from any content on our website without express written permission.

Customer-Uploaded Designs

When you upload a design or artwork for custom printing, you retain full ownership of that intellectual property. By uploading, you grant The Prints Plus a limited, non-exclusive, royalty-free licence to use, reproduce, and modify the design solely for the purpose of fulfilling your order (including producing proofs, printing, and quality checks). We will not use your designs for marketing, resale, or any other purpose without your explicit consent.

You represent and warrant that you own or have obtained all necessary rights, licences, and permissions for any design you upload, and that printing such design does not infringe on the intellectual property rights of any third party. You agree to indemnify The Prints Plus against any claims arising from intellectual property infringement related to your uploaded designs.

8. User Conduct

When using our website, you agree not to:

• Upload, transmit, or request printing of any content that is unlawful, defamatory, obscene, pornographic, hateful, or otherwise objectionable.
• Infringe on the intellectual property rights, privacy, or other rights of any third party.
• Attempt to gain unauthorised access to our systems, servers, or other users' accounts.
• Use automated bots, scrapers, or other tools to access or interact with our website without our written consent.
• Interfere with or disrupt the operation of our website or the servers and networks connected to it.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we reasonably believe any of these terms have been violated.

9. Order Cancellation

Standard (non-custom) product orders may be cancelled within 2 hours of placement, provided the order has not yet entered production or been dispatched. Custom and personalised orders are non-cancellable once production has started. 10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, The Prints Plus, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our website or services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to these Terms or your use of our services shall not exceed the total amount paid by you for the specific order giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable Indian law.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Prints Plus, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of our services, your uploaded content, or your infringement of any third-party rights.

12. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by The Prints Plus. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Accessing third-party links is at your own risk, and we encourage you to review the terms and privacy policies of any external website you visit.

13. Force Majeure

The Prints Plus shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supply chain disruptions, strikes, equipment failures, internet or power outages, or acts of terrorism. In such events, our obligations under these Terms shall be suspended for the duration of the force majeure event.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts located in Surat, Gujarat, India.

Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes amicably through direct negotiation. If a resolution cannot be reached within 30 days, either party may pursue legal remedies in the courts of Surat, Gujarat.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
